1. Acceptance of terms
By installing or using Horizon Clock ("the Service") from the monday.com marketplace, you ("you," "Customer") enter into a binding agreement with 9153-3133 Quebec Inc., doing business as Horizon Nord ("we," "us," "Horizon Nord"). If you are accepting these terms on behalf of a company, you represent that you have authority to bind that company.
If you do not agree with any part of these terms, do not install or use Horizon Clock.
2. Description of service
Horizon Clock is a monday.com marketplace application that provides GPS-verified time tracking for construction crews and field service teams. The Service writes shift records to monday.com boards in your workspace, applies geofence verification, and presents supervisor views (including the "Today's Crew" live view) inside monday.com.
Horizon Clock requires an active monday.com subscription. Your monday.com plan, monday.com data, and your relationship with monday.com Ltd. are governed by monday.com's own terms of service, separate from these terms.
3. Your account and responsibilities
You are responsible for:
- Maintaining the accuracy of information you provide (worker names, project addresses, geofence radii, overtime rules).
- Informing your workers that time tracking with GPS verification is in use and obtaining any consents required under applicable employment and privacy law.
- Using Horizon Clock in compliance with applicable laws, including labour, employment, privacy, and tax laws in your jurisdiction.
- Maintaining the security of your monday.com administrator credentials.
- Configuring monday.com permissions appropriately so workers see what they need and supervisors can review shifts.
You agree not to use Horizon Clock to harass workers, falsify time records, or violate any law.
4. Subscription plans and pricing
Horizon Clock is offered on three flat-rate monthly tiers, billed in Canadian dollars (CAD) through monday.com's billing system:
- Starter: $49 CAD/month (or $40/month billed yearly) — up to 5 active workers.
- Pro: $149 CAD/month (or $122/month billed yearly) — up to 25 active workers.
- Enterprise: $449 CAD/month (or $368/month billed yearly) — up to 100 active workers.
"Active workers" means workers who clocked in at least once during the billing period.
If your active worker count exceeds your plan limit, you will be prompted to upgrade. We will not block clock-ins, but Horizon Nord may suspend access to supervisor views and reports until you upgrade or reduce active worker count.
For organizations with more than 100 active workers, custom enterprise pricing is available. Contact [email protected].
5. Free trial
New accounts receive a 14-day free trial of the Pro plan, with no credit card required to start. At the end of the trial, you will be prompted to choose a paid plan. If no plan is selected, supervisor features will be restricted but historical shifts remain accessible in your monday.com Time Entries board.
6. Refunds
We offer a 30-day money-back guarantee from the date of your first paid invoice. If you are not satisfied with Horizon Clock for any reason, email [email protected] within 30 days of your first paid invoice and we will refund that invoice in full.
After the 30-day window, subscription fees are non-refundable. Annual subscriptions can be cancelled at any time but remain billed through the end of the current annual term.
7. Cancellation and termination
You may cancel your Horizon Clock subscription at any time from monday.com's billing settings or by uninstalling Horizon Clock from your monday.com workspace. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access to Horizon Clock if you:
- Materially breach these terms and do not cure the breach within 14 days of written notice.
- Use the Service in a manner that threatens the security, integrity, or availability of Horizon Clock for other users.
- Fail to pay subscription fees when due.
- Use the Service to facilitate illegal activity.
On termination, your monday.com Time Entries board (with all historical shifts) remains in your monday.com workspace under your control. Horizon Clock internal database related to your account is permanently deleted within 10 days, as required by the monday.com marketplace.
8. Intellectual property
Horizon Clock, including its software, design, documentation, and trademarks, is the property of Horizon Nord and protected by Canadian and international intellectual property law. We grant you a non-exclusive, non-transferable, revocable licence to use Horizon Clock during your active subscription, solely for your internal business purposes.
You retain ownership of all data you input into Horizon Clock, including worker information, project information, and shift records.
You may not reverse-engineer, decompile, copy, sublicense, or resell Horizon Clock without our written permission.
9. Data ownership and processing
You retain full ownership of your data. Shift records are written to your monday.com Time Entries board, which you control. Horizon Nord acts as a data processor with respect to personal information about your workers, as described in our Privacy Policy.
10. Disclaimers and limitation of liability
Horizon Clock is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
GPS accuracy varies by device, environment, and network conditions. We do not guarantee that GPS coordinates are accurate or that the geofence verification will be correct in every case. You are responsible for reviewing shifts and confirming hours before using them for payroll.
To the maximum extent permitted by applicable law, in no event will Horizon Nord total aggregate liability arising out of or relating to these terms exceed the total fees you paid for Horizon Clock in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold Horizon Nord harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from your use of Horizon Clock, your violation of these terms, or your violation of any law or third-party rights.
12. Governing law and disputes
These terms are governed by the laws of the Province of Quebec and the laws of Canada applicable in Quebec, without regard to conflict-of-law principles. Any dispute relating to these terms or to Horizon Clock shall be resolved exclusively in the courts of the District of Montreal, Quebec, Canada, and you consent to the personal jurisdiction of those courts.
13. Changes to these terms
We may update these terms from time to time. When we make material changes, we will notify account administrators by email and post the revised terms with an updated "Effective date" at the top of this page at least 30 days before they take effect. Continued use of Horizon Clock after the effective date constitutes acceptance of the revised terms.
